By placing an order or accessing Our Shop (accessible at https://shop.makersweare.com), you agree that you have read these Terms and Conditions and that you agree to be bound by them.
Registration and Purchase
1. In order to purchase products or services at Our Shop, you are required to first register as a member of The Makers under the Website (the “Account”) and press the button “log in” on the subpage under the Website to gain access to Our Shop through the Account. Once you press the “log in” button, you warrant that you are the owner of the Account and aged at least 18 years old. All activities that occur under your Account, whether or not the activities are conducted by you, shall be deemed activities to be conducted by you, with your due authorisation.
2. Certain products available at Our Shop may be exclusive to members of designated fan clubs or platforms. To verify your eligibility, you may be required to provide a valid membership number or proof of membership in the relevant fan clubs or platforms.
3. We strive to ensure that the product prices, details and size specifications displayed in Our Shop are accurate and up to date. We reserve the right to modify the product prices, details and size specifications on Our Shop at any time to reflect the most up to-date information available.
4. The product images displayed on Our Shop are for reference and illustrative purposes only. The actual size, colour, design of the product may differ from the images shown.
5. All orders are subject to product and stock availability. Allocation of products will be made on a first-come, first-served basis, determined by the date and time of successful and completed transactions as recorded in our system. We reserve the right to cancel your order in the event that any of the products or services requested are or becomes unavailable. We will not hold products in unpaid carts or pending orders.
6. We shall not be held responsible for any failures, delays, system or technical problems, or other issues that may result in your failure or inability to complete the purchase process.
7. Once an order has been placed, no cancellations, changes, or delivery modifications will be accepted, except as otherwise required by applicable law.
8. We reserve the right to cancel your order at our sole discretion. Without prejudice to the aforementioned rights, we retain the right to refuse or cancel your order under any of the following circumstances:
(a) The information provided by you at the time of purchase is incorrect, inaccurate or incomplete.
(b) Insufficient stock is available for the product you have purchased, regardless of whether we have previously informed or confirmed to you that stock was sufficient.
(c) We are unable to arrange delivery to your designated delivery address.
In the event that we cancel an order, we will notify you via email regarding the refund arrangements. To the fullest extent permitted by law, we accept no liability for any losses incurred or suffered arising from such cancellation.
Payment
9. Our Shop accepts various payment methods, including Visa, Mastercard, UnionPay and Diners Club (individually “Selected Payment Method”, and collectively “Selected Payment Methods”). All payments shall be made in Hong Kong Dollars (HKD). The payment (in whole or part thereof), once paid, is non-refundable under any circumstances, unless specified herein or we agree otherwise.
10. Prices of the products are exclusive of any government service tax, value added tax or similar tax (if any) and subject to change from time to time without prior notice. Pricing or typographical errors may occur and in the event that a product is listed at an incorrect price, we shall have the right at our sole discretion to decline or cancel any orders placed for that product, or to contact you for purchase instructions based on the correct price information.
11. Upon order acceptance, you hereby authorise us to debit the total amount from the Selected Payment Method by us or via our billing agent . Your bank, the credit card issuing company and/or other relevant parties ("Bank") may charge you additional fees for making payment with your Selected Payment Method. Please make enquiries with the Bank for details. You warrant that you have obtained all necessary due authorisation for making payment via the Card account. By your Selected Payment Method, you are we deemed to have consented or been obtained necessary consent (if applicable) that you have obtained consent to make purchase with such Selected Payment Method, irrespective of your age and capability, and we shall not entertain any dispute or complaint in relation to this. Any disputes regarding the payment must be raised within 30 days from the order acceptance date, notwithstanding, where relevant, any terms to the contrary in any cardholder agreement with the Bank.
12. It is essential that the account for your Selected Payment Method is in normal operation during the debit process; otherwise the order will be deemed invalid. To ensure a smooth ordering process, if you prefer to use a credit card for payment, we recommend using a credit card that is eligible for the “Verified by Visa” or “Mastercard® SecureCode™” service provided by the issuing bank. 13. After placing an order and successfully completing the payment on Our Shop, please check your registered email address for an order confirmation email sent by us.

Shipping and Delivery

16. We currently only deliver to valid postal addresses within Hong Kong (excluding P.O. Boxes.) For more information regarding our shipping and delivery policy, please refer to our Shipping Policy.
17. Customers shall assume all shipping risks associated with the delivery of their products once the products have been transferred to the carrier (including SF Express). We do not provide any guarantee regarding the condition or safe arrival of the product during the delivery process.
18. If you select the “self-pickup point” option for your items, please ensure that your orders are collected on the designated date(s) as specified. Please collect your order strictly within the designated collection period. In the event that the goods are not collected from the self-pickup point within the designated pick up period, the goods will be returned to our warehouse. We will contact the customer to make arrangement for re-shipment, and the shipping costs shall be borne by the customer. For the avoidance of doubt, we cannot accept any requests for order cancellation or refunds due to your failure or inability to pick up the order within the designated pick-up period.

In the event that we suspect or discover any such activities, we reserve the right to cancel your order, terminate your Account and/or take appropriate legal action.

24. We shall not be held liable to you or any third party for any delay or failure to perform (including without limitation to delays or non-performance) that is caused by or results from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.

26. To the maximum extent permitted by law:
(a) We shall not be held liable to you for any indirect, incidental, special, or consequential damages arising from or related to the goods or services you purchase from Our Shop; and
(b) Our total aggregate liability to you arising from or in connection with the goods or services you purchase from Our Shop, whether in contract, tort or otherwise, shall not exceed the total price paid by you for such goods or services.

28. If any provision of these Terms is found invalid, the remaining provisions shall continue in full force and effect.
29. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong in respect of any dispute arising out of or in connection with these Terms and Conditions or product orders.
30. In the event of any inconsistency between the English language version of these Terms and Conditions and the Chinese version, the English language version shall prevail.
